Minors - Juvenile/Child

Municipal court has jurisdiction over minors (younger than 17) charged with Class C misdemeanor offenses, Public Intoxication (under age 21), Possess/Consume Alcohol (under age 21), and Possess Tobacco (under age 21). All minors must appear in open court for all proceedings in their case. The parent or legal guardian of a minor younger than 17 must appear in court with his or her child.

WARNING: A child and parent or legal guardian required to appear before the court has an obligation to provide the court in writing the current address and residence of the child. The obligation does not end when the child reaches age 17. On or before the seventh day after the date the child or parent changes residence, the child or parent shall notify the court of the current address in writing. Failure to do so is a Class C misdemeanor.

Minor (Under Age 21) Charged with Alcohol Violations

If you have an alcohol violation and you do not want a trial, you may plead no contest or guilty and be placed on deferred disposition (only for first offense). You will be required to do the following:

  1. Pay the state costs and a special expense fee;
  2. Complete an approved alcohol and/or drug awareness program; and
  3. Perform 8 to 40 hours of alcohol-related community service as a condition of deferred disposition; and
  4. Complete any additional requirements by the judge.

If you timely comply with the deferred disposition order, your case will be dismissed.

IMPORTANT

Failure to comply may result in the denial or suspension of your driver's license for up to six months.

Minor (Under Age 21) Charged with Tobacco Violations

If you have a tobacco violation and you do not want a trial, you may plead no contest or guilty and the court will suspend execution of the judgment. You will be required to do the following:

  1. Pay the state costs on the date your plea is entered; and
  2. Complete an approved e-cigarette and tobacco awareness program within 90 days.

If you complete the course and timely submit a certificate of completion to the court, the judge will dismiss the case.

If you have a subsequent tobacco violation, and you do not want a trial, you will be required to repeat the process above; however, this time a conviction will be entered and a fine imposed.

IMPORTANT

Failure to comply may result in the denial or suspension of your driver's license for up to 180 days.
